Frequently asked questions
Does an Indian trademark protect me abroad?
No. Trademark rights are territorial. An Indian registration protects you only in India; you need protection in each country or region where you do business.
What is the Madrid Protocol?
An international system run by WIPO. Through IP India you can file one international application, based on your Indian mark, and designate many member countries. Each country then examines it under its own law.
Is Madrid cheaper than filing country by country?
Often, for three or more member countries. But many countries charge individual fees, and Madrid adds a five-year dependency on your Indian mark, so direct filing can be better for one or two key markets.
What is the five-year dependency?
For five years from the international registration date, the international registration depends on your Indian basic mark. If the Indian mark is refused or cancelled in that time, protection abroad falls with it. It can be transformed into national applications within a set period, at extra cost.
Can I file through Madrid before my Indian mark is registered?
Yes. A pending Indian application can serve as the basic mark. If it later faces problems, the dependency risk applies.
Which countries are not in the Madrid system?
Among popular markets, Hong Kong, Kuwait, South Africa, Nigeria and Chile currently require direct filing. A Madrid designation of China does not cover Hong Kong.
What is priority, and why does six months matter?
If you file abroad within six months of your Indian filing, you can claim your Indian filing date in those countries. That protects you against anyone who files in the meantime.
How long does international registration take?
It varies by office, from a few months in the UK to well over a year in some countries. Under Madrid, offices have 12 or 18 months to refuse a designation. We never promise dates the offices control.
Do I need a local attorney in each country?
Many offices require a local representative or address for service for direct filings. Under Madrid, local associates are usually needed only if an office raises a refusal. We coordinate them for you.
How are international fees calculated?
Professional fee, the office’s official fee in its own currency (or WIPO fees for Madrid), and GST on the professional fee, each shown separately. Foreign amounts are converted at indicative rates and confirmed in your formal quotation.
Are objection responses included?
No. Responses to objections, refusals and oppositions are quoted when they arise, because the work depends on each office’s findings.
Can a foreign company file in India through you?
Yes. A foreign company can register in India; it needs an address for service in India, which we provide.
