Trademark FAQs

Short answers to the questions people ask most about trademarks.

Frequently asked questions

Can I file a trademark myself?

Yes. In India you can file directly on the IP India portal. What you take on is class selection, drafting the description of goods and services, and replying to any objection. IPVenture helps with those parts, and you can choose how much help you want.

Which class should I choose?

Choose the classes that cover what you actually sell. A clothing label with its own online store usually needs class 25 for the clothes and class 35 for retail services. The class finder suggests classes from a plain description; a trademark attorney confirms them before filing.

Does my Indian trademark protect me abroad?

No. Trademarks are territorial. You need protection in each market, either by filing directly in each country or through a Madrid Protocol application designating them.

What makes up the price?

Three parts: our professional fee, GST on that fee, and the official fee charged by the trademark office. Official fees are passed through at cost and shown on a separate line.

What happens after I file?

The office examines the application. If there’s an objection, you get a chance to reply. Accepted marks are advertised so others can oppose. If there’s no opposition, or it fails, the mark proceeds to registration.

Do you guarantee registration?

No one can. Each trademark office examines the mark and decides. We can tell you the risks we see, prepare a strong application and respond to objections, but the outcome and the timeline rest with the office.

Can I add classes after filing?

Broadly, you can narrow the goods or services after filing, but you can’t widen them. If you need more coverage later, it means a new application. Choose carefully at the start.

Should I use the Madrid Protocol?

It can be efficient for several markets at once. The trade-off is that for five years the international registration depends on your Indian base application. For one or two markets, or if your Indian application faces objections, direct filing is often safer.

Are the prices final?

Our professional fees are as shown. Official fees can change, and foreign fees depend on exchange rates, so your quotation confirms every amount before you pay.

How long is a trademark valid?

In India, ten years, renewable every ten years without limit.

What is the difference between ™ and ®?

™ can be used any time to claim a mark as your brand. ® is only for registered marks. In India, presenting an unregistered mark as registered is an offence under section 107 of the Trade Marks Act, 1999.

Is one class enough?

Sometimes. Many businesses need two: one for the product and one for how they sell or deliver it.

Can a foreign company file in India?

Yes. Foreign applicants need an address for service in India, which a trademark attorney provides. Choose “Foreign entity” as applicant type.

What is the India official fee?

For e-filing, ₹4,500 per class for individuals, startups and small enterprises, and ₹9,000 per class for other applicants.

What if someone opposes my mark?

In India, an opposition can be filed within four months of the mark being advertised. You then file a counter-statement and the matter is decided by the Registry.
