Frequently asked questions

How long do I have to reply to a trademark objection?

The deadline is stated in the examination report, usually one month. If no reply is filed, the application can be treated as abandoned.

Can a descriptive mark still be registered?

Yes, if you show it has become distinctive through long and wide use. Dated invoices, ads and sales figures help.

What if the examiner cites a similar mark?

The reply explains differences in look, sound, meaning and goods, and may narrow your goods or services to remove the conflict.

What happens after the reply?

The examiner may accept the application or fix a show cause hearing to discuss it further.

How long do I have to reply to a trademark examination report in India?

Within the period stated in the report, usually one month from the date you receive it. File early: if no reply is filed, the application can be treated as abandoned.

Can I keep using ™ while my application is objected?

Yes. ™ only tells people you claim the mark. You can use ® only after the mark is registered.

What happens after I file the reply?

The examiner either accepts the mark for advertisement in the Trade Marks Journal or lists a show-cause hearing to discuss the objections that remain.

Will a section 11 objection always lead to refusal?

No. Differences in the marks, the goods or services and the trade channels, or evidence of honest concurrent use, can overcome it. The outcome depends on the facts.
